These Terms of Service (“Terms”) govern your use of the website aquatek-roofing.com (the “Site”) operated by Aqua-Tek Roofing LLC (“Aqua-Tek,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms.
These Terms apply to website use only. The terms of any roofing project agreement are governed separately by a written contract signed between you and Aqua-Tek Roofing LLC.

Aqua-Tek Roofing LLC is a Pennsylvania-licensed roofing contractor (PA license PA-200048) specializing in commercial and residential flat roofing and metal roofing. Our office is located at 278 Switzgabel Drive, Brodheadsville, PA 18322. We serve Pennsylvania exclusively.

Estimates and contracts
Free estimates are provided on a no-obligation basis for projects in our Pennsylvania service area. An estimate is not a contract. A binding agreement to perform work arises only when a written contract is signed by both parties.
Pennsylvania’s Home Improvement Consumer Protection Act (HICPA) governs residential home improvement contracts in Pennsylvania, and our residential contracts comply with HICPA disclosure requirements. We are registered with the Pennsylvania Attorney General’s Bureau of Consumer Protection as a Home Improvement Contractor.
Right of cancellation (residential)
For residential home improvement contracts under Pennsylvania law, you have the right to cancel the contract within three (3) business days of signing, without penalty or obligation. Notice of cancellation must be given in writing.
Use of the Site

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AQUA-TEK ROOFING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE.
This limitation applies to Site use. It does NOT limit our liability under signed project contracts, our 5-year labor warranty, or under Pennsylvania consumer protection laws.

Our 5-year labor warranty
Roofing projects performed by Aqua-Tek include a 5-year labor warranty. The terms of the warranty are provided in writing at project completion. Material warranties are provided directly by manufacturers and have separate terms.
Warranty information shown on the Site is general. Specific warranty terms applicable to your project are governed by the written warranty document delivered with your project.
Indemnification
You agree to indemnify and hold harmless Aqua-Tek Roofing LLC, its employees, and agents from any claims arising out of:
— Your violation of these Terms
— Your misuse of the Site
— Content you submit through the Site (including project photos, reviews, or testimonials)
This does not apply to liability that cannot be limited under Pennsylvania law.
Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws principles.
Disputes related to website use will be resolved exclusively in the state or federal courts located in Monroe County, Pennsylvania.
Disputes related to website use shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Monroe County, Pennsylvania. This arbitration provision does not apply to claims that cannot be subject to arbitration under Pennsylvania law, including residential home improvement claims under HICPA, which remain subject to Pennsylvania court jurisdiction.
Disputes regarding actual roofing projects (not website use) are governed by the project contract, applicable Pennsylvania law including HICPA, and any dispute resolution mechanism specified in the contract.
